Notice is hereby given that, in accordance with L.R.S. 3:1609 and LAC 7:XV.314(A), the Louisiana Department of Agriculture & Forestry, Louisiana Boll Weevil Eradication Commission, has established a boll weevil eradication zone, the Louisiana Eradication Zone, consisting of all the territory within the state of Louisiana.
Notice is further given that all producers of commercial cotton in Louisiana are required to participate in the boll weevil eradication program, including cost sharing, in accordance with the Boll Weevil Eradication Law and regulations. This includes, but is not limited to, reporting of cotton acreage and paying of assessments each crop year, and destruction of cotton plants and stalks by December 31 of each crop year. The successful Bidder shall be required to furnish a Performance and Payment Bond written by a company licensed to do business in Louisiana, in an amount equal to 100% of the Contract amount. Surety must be listed currently on the U. S. Department of Treasury Financial Management Service List (Treasury List) as approved for an amount equal to or greater than the contract amount, or must be an insurance company domiciled in Louisiana or owned by Louisiana residents. If surety is qualified other than by listing on the Treasury list, the contract amount may not exceed fifteen percent of policyholders' surplus as shown by surety's most recent financial statements filed with the Louisiana Department of Insurance and may not exceed the amount of $500,000. However, a Louisiana domiciled insurance company with at least an A- rating in the latest printing of the A. M. Best's Key Rating Guide shall not be subject to the $500,000 limitation, provided that the contract amount does not exceed ten percent of policyholders' surplus as shown in the latest A. M. Attendance at this conference is required and bidders are advised that they will be required to state on the bid form that they have personally inspected and are familiar with the project site.
Bids shall be accepted from Contractors who are licensed under LA. R.S. 37:2150-2163 for the classification of Highway, Street and Bridge Construction. Bidder is required to comply with provisions and requirements of LA R.S.38:2212 (A)(1)(c). No bid may be withdrawn for a period of thirty (30) days after receipt of bids, except under the provisions of LA. R.S. 38:2214(C).
The Owner reserves the right to reject any and all bids for just cause. In accordance with La. R.S. 38:2214 (A) (B) (1) (2) (3) (4) (5), the provisions and requirements of this Section, those stated in the advertisement bids, and those required on the bid form shall not be considered as informalities and shall not be waived by any public entity.
When this project is financed either partially or entirely with State Bonds or federal funds, the award of this Contract is contingent upon the granting of lines of credit, the sale of bonds by the Bond Commission or the commitment of federal funds. RESOLUTION
A resolution giving preliminary approval to the issuance of not exceeding Twelve Million Three Hundred Forty Thousand Dollars ($12,340,000) of Sales Tax Bonds, Series 2010B, of the City of Plaquemine, State of Louisiana; providing certain terms of said bonds; making application to the State Bond Commission for approval of said Bonds; and providing for other matters in connection therewith.
WHEREAS, the Parish of Iberville, State of Louisiana (the "Parish") is now levying and collecting a two-thirds percent (2/3%) sales and use tax pursuant to an election held on July 13, 1991 (the "1991 Tax"); and
WHEREAS, the Parish of Iberville, State of Louisiana (the "Parish") is now levying and collecting a one percent (1%) sales and use tax pursuant to an election held on July 16, 2005 (the "2005 Tax"); and
WHEREAS, the Parish of Iberville, State of Louisiana (the "Parish") is now levying and collecting a one percent (1%) sales and use tax pursuant to an election held on September 30, 2006 (the "2006 Tax"); and
WHEREAS, pursuant to the authority of the aforesaid elections, the Issuer adopted ordinances on August 6, 1991, December 20, 2005 and April 21, 2006 (collectively, the "Tax Ordinance"), providing for the levy and collection of the 1991 Tax, the 2005 Tax and the 2007 Tax (the 1991 Tax, the 2005, and the 2006 Tax being herein referred to collectively as the ATax@); and
WHEREAS, in accordance with the provisions of the Tax Ordinance the Net Revenues of the Tax (as hereinafter defined) shall be available for appropriation and expendi_ture by the Issuer for the purposes designated in the propositions authorizing the levy of the Tax, which includes the payment of bonds authorized to be issued in accordance with Louisiana law; and
WHEREAS, the Issuer has no outstanding bonds or other obligations of any kind or nature payable from or enjoying a lien on any portion of the Net Revenues of the Tax herein pledged, except the outstanding (i) Sales Tax Bonds, Series 2008 and (ii) Sales Tax Bonds, Series 2010A (collectively, the AOutstanding Parity Bonds@); and
WHEREAS, the Issuer desires to make formal application to the State Bond Commission for approval of the Sales Tax Bonds, Series 2010B described below;
